ADVISORY ON POEA MC #5

On March 22, 2018, the Philippine Overseas Employment Administration (POEA) issued Memorandum Circular No. 05, Series of 2018-05-09 entitled, “Guidelines on the Registration of Direct Individual Employers of Household Service Workers”, which laid down the documentary requirements to be submitted by employers seeking to hire Household Service Workers (HSWs) from the Philippines.


For HSW recruitment in Canada, the following requirements apply:


  1. A copy of the formal arrangement b·etween the individual direct employer and the designated Philippine Recruitment Agency (PRA) on the hiring of an HSW;

  2. An Employer Profile with the complete address and contract information, proof of capacity to employ and pay wages, and number of persons in the household;

  3. Certification from their local police that the employer, or any of the immediate family members, has no criminal record AND has not been implicated in any case of abuse;

  4. Employment Contract emphasizing the superior terms and conditions of employment; and,

  5. Visa or work permit or similar documents such as Labor Market Impact Assessment (LMIA) from Service Canada or approval application from the Provincial Nominee Program/ Certificate of Nomination, if appropriate.

Please note that MC 5 did not remove the requirement for a Foreign Recruitment Agency (FRA) in the recruitment and employment of HSWs as mandated by POEA Governing Board Resolution No. 07 Series of 2006. MC 5 rather supplements the. aforementioned Board Resolution.

Employers seeking to hire Filipino HSWs under the Temporary Foreign Workers Program in Canada may, therefore, either recruit the said workers through a Philippine Recruitment Agency (PRA) and an FRA OR through a PRA and submit the documentary requirements set forth under MC 5.
